TERMS AND CONDITIONS
1. LESSEE/ASSOCIATE: Licensed business owner or operator leasing from: SERENITY SALON SUITES NORTH, LLC
2. BUILDING ACCESS: Serenity Salon Suites North, LLC shall have no liability to Lessee, its employees, agents, invitees for losses due to theft/burglary, or for damage not directly caused by agent of Serenity Salon Suites North, LLC or its agents. Neither shall Serenity Salon Suites North, LLC be required to insure against any such losses.
a. Each suite will have a key controlled (physical or electronic) locking mechanism.
b. By entering into this agreement; Lessees, their agents and invitees understands and agrees that for safety, property and security purposes, Serenity Salon Suites North, LLC retains the right to electronically or physically monitor areas within the building. This includes the use of video/audio method, and will remain the sole property of Serenity Salon Suites North, LLC.
c. Serenity Salon Suites North, LLC has a common entry, window and motion alarm system. Individual suites are not alarmed.
d. Serenity Salon Suites North, LLC shall have no duty regarding security of the building or its perimeter, beyond those described above.
3. DEFAULT BY ASSOCIATE: If any default is made in the payment of rent or other sum due here under or in compliance with any other term or condition within this lease, at the option of Owner, shall terminate and Owner may re-enter the premises and remove all persons and equipment, and in any event Owner may pursue such other and further remedies as are allowed by law. Written notice shall be delivered to the Salon Suite of any default or breach. Termination of this lease shall not result if within two (2) days of delivery of such notice, Associate has corrected the default or breach.
4. EQUIPMENT: Common area furnishing and equipment such as wash bowls, hair dryers and waiting area chairs.
5. GENERAL: No oral agreements have been entered into between the parties, and this Lease, along with the Rules and Regulations and policy changes herein referenced, constitute the entirety of this agreement. This Lease is binding upon the parties hereto and their respective heirs, successors and assigns.
6. HEATING & AIR CONDITIONING: Hours for heating and cooling of the building will be during the normal opening hours as established by Serenity Salon Suites North, LLC.
7. UTILITIES: Normal operating electricity, water, sewer, and common area trash removal will be administered by Serenity Salon Suites North, LLC or it’s representative.
8. LEGAL COSTS Lessees/Associate agrees to pay all costs and expenses, including reasonable attorneys' fees, incurred by Serenity Salon Suites North, LLC, as a result of any default by Lessee under the terms of this agreement.
9. MAINTENANCE: Lessee is responsible for ensuring their clients/guests; complies with the proper care and cleanliness requirements while in all common areas, restrooms, waiting areas, corridors, and use of common dryers or shampoo equipment. Covered service requests should be submitted to our website service portal.
a. Lessee/Associate’s will be solely responsible for keeping leased suite free of overnight trash and will keep leased suite clean and free of rodent and pest attracting material/food.
10. MULTIPLE LESSEES/ASSOCIATES: In the event more than one Lessee signs this Lease, each is jointly and severally liable for all sums due under this Lease.
a. There shall be assessed a $30.00 late charge for the first day payment is past due, which is also the Grace Period.
b. Lessees will be considered in breach/default of this agreement, if payment and an additional late fee of $50 is not received by the end of the second day past the initial due date.
c. Conversely, Lessees/Associates may receive a five percent (5%) discount at Serenity Salon Suites North, LLC if an eight-week lump sum of rent is paid in advance.
16. RENT INCREASE: Serenity Salon Suites North, LLC shall give 30 days notice to Lessee/Associate of any change in the amount of the rent.
a. Serenity Salon Suites North, LLC agrees that no increase in rent shall occur during the first lease term, unless Lessee is on a promotional special period.
17. SIGNAGE: Building directory and suite identification/signage shall be in keeping with the requirements established by Serenity Salon Suites North, LLC.
18. RESPONSIBILITY FOR LOSSES; INDEMNITY: Serenity Salon Suites North, LLC and its representatives shall not be responsible for losses due to theft, burglary, negligence of the Lessee, or its invitees/clients. Furthermore, Serenity Salon Suites North, LLC or its representatives shall not be liable for personal injury to any Lessee/Associate and/or their customers.
a. Lessee/Associate agrees to indemnify and hold harmless Serenity Salon Suites North, LLC and its representatives, with respect to conduct or actions by the Lessee, or Lessee’s invitees/clients, that results in any injuries or losses.
b. Lessor/Owner is indemnified against any liability, claims, or business losses due to acts of God, "Force Majeure," as well as public or private utilities failures/interruption.
19. RIGHT OF INSPECTION: Owner and Owner's agents shall have the right at all reasonable times during the term of this Lease to enter the Salon Suite for the purpose of inspection and / or repair.
20. ELECTRONIC MONITORING: Lessee/Associates understand, agree, and will inform their invitees/clients that Serenity Salon Suites North, LLC will monitor (video and audio) all common areas via physical or electronic methods. Further that monitoring is solely for the purpose of individual and property protection. Also that all related data is the sole ownership of Serenity Salon Suites North, LLC, and that Serenity Salon Suites North, LLC at its sole discretion, may use the data for law enforcement or civil litigation.
21. RULES & REGULATIONS: Lessee/Associates shall comply with all terms and conditions herein, along with any posted signage established by Serenity Salon Suites North, LLC or its representatives.
a. Also, Serenity Salon Suites North, or its Representatives, may make reasonable policy changes that are applicable to all Lessees/Associates and supplement the terms herein. All policy changes, especially those impacting people and property interests, shall be effective immediately and constitute a part of this Lease.
22. SECURITY DEPOSIT: Lessee/Associate agrees that the Security Deposit (one month’s rent) will be paid at the signing of the Lease. The Security Deposit is not advance rent and cannot be applied to rent by Associate. Refunds of the Security Deposit shall be made in accordance with the terms of this Lease. A CONDITION TO THE REFUND OF THE SECURITY DEPOSIT IS THAT LESSEE/ASSOCIATE MUST PROVIDE SERENITY SALON SUITES NORTH LLC, OR ITS REPRESENTATIVES, WRITTEN NOTICE OF SURRENDER OF THE SALON SUITE AT LEAST THIRTY (30) DAYS PRIOR TO VACATING THE SALON SUITE.
a. If associate is not in default, Owner will release the refundable portion of the Security Deposit, minus amount for identified suite repair/damage etc., normally within seven (7) business days after suite inspection.
23. SECURITY DEPOSIT DEDUCTIONS: Prior to refund, deductions will be made from the Security Deposit for the following items:
a. A cleaning charge of $50.00. The cleaning charge will be waived if the Serenity Salon Suites North, LLC is returned in the same condition as noted in condition report in this agreement.
b. Owner's actual expenses for damages beyond normal wear and tear to the Serenity Salon Suites North, LLC or its contents.
c. Damages resulting from Lessee/Associate's failure to give proper notice of termination.
d. Any other unpaid sums due to Serenity Salon Suites North, LLC or it’s Representatives under the terms of this Lease, including, but not limited to, late charges, returned checks, NSF charges, administrative costs, charges for replacement of lost access cards, charges for changes of locks because of lost keys, and other unpaid fees
24. SUBLETTING: The Serenity Salon Suites North, LLC will be occupied only by the Lessees/Associate specified on page one of this Lease.
a. No other persons shall be permitted the use of the facilities. If tenant is found in violation for the subletting, this lease is subject to immediate termination for Default, and Security Deposit will be forfeited due to Default.
25. TERMINATION OF LEASE: Associate may terminate this Lease provided: (a) Associate gives Serenity Salon Suites North, LLC, NINETY (90) days written notice of termination; and
a. Lessee/Associate pays all rents and other charges due through the date of termination.
b. Upon termination of the Lease for whatever cause, Lessee/Associate agrees to promptly and professionally vacate the Serenity Salon Suites North, LLC, and immediately remove all Lessee/Associate’s self-furnished equipment.
c. Return the suite in the same condition as and when received, except for reasonable wear and tear. It is agreed that if Lessee/Associate fails to promptly remove non Serenity Salon Suites North, LLC, property, it will be removed and stored at Lessees/Associate expense. Further, that Lessee/Associate will be solely responsible for the subject property once placed in storage, including all payments.
26. A background check will also be completed at the lessee’s expense, and the cost will be deducted from the first month’s lease upon acceptance.
